Uzbekistan introduces new rules for marketing SMS and calls

Uzbekistan has approved new regulations governing advertising text messages and promotional phone calls, which will take effect on November 1st. According to these rules, companies and mobile operators are required to obtain prior consent from subscribers before sending marketing messages.

The new requirements stipulate that consent to receive advertisements must be provided either in written or electronic form. This rule applies to both legal entities and private individuals using mobile networks to distribute advertising materials.

Restrictions on sending times

Furthermore, the regulations introduce limitations regarding the times during which companies can contact subscribers. It is prohibited to make promotional calls or send SMS via mobile networks between 6:00 PM and 9:00 AM.

Subscribers retain the right to independently decide whether they wish to receive advertising messages and calls. Users who wish to opt out of such communications can contact their mobile operator to request the blocking of advertising messages. They are given the option to limit such contacts completely or partially, giving them greater control over the advertising they receive.

The changes also affect enterprises engaged in mass advertising campaigns. Companies conducting large-scale promotional activities are now obliged to register the systems they use in a special state registry for personal data processing.

These new requirements aim to regulate advertising communications via mobile networks and protect subscribers from unwanted calls and messages. Companies must respect subscriber preferences and adhere to legal restrictions.

Violation of the new requirements will result in liability according to advertising and personal data protection legislation. The document also includes changes concerning state information systems. Specifically, starting October 1, 2026, changes to citizens' personal information must automatically be reflected in all relevant state databases through an interdepartmental data exchange system.
