The Etkiweni Municipality has issued an order for the popular Surf Riders cafe, located on Durban's waterfront, to vacate its premises by Wednesday, September 30th.
Surf Riders Cafe is situated on Durban Beach, in the South Beach area, near the promenade and the uShaka Marine World aquarium. It is known for its relaxed, surfing-inspired atmosphere, ocean views, and simple food, making it a favorite spot for both locals and tourists.
However, the future of the cafe on the South Beach grounds came into question after the municipality sent an official notice to Lebotrax (Pty) Ltd, which operates under the name Surf Riders Café.
Lease term expired many years ago
According to the municipal letter, the lease agreement between Etkiweni and Lebotrax ceased to be valid on March 31, 2019. After the expiration of the lease, the cafe continued to occupy the premises under monthly rental terms.
The municipality notified them: 'This serves as written notice within one calendar month to vacate the premises and hand over the vacant spaces to the Etkiweni Municipality no later than September 30th.'
Cafe must leave the premises in good condition
The municipality emphasized that the premises must be returned in the condition required by the original lease agreement. It was specified that 'the premises must be clean, tidy, sanitary, and in good condition.'
Furthermore, the municipality stated that any damaged or spoiled elements, fixtures, fittings, windows, doors, panels, or display cases must be repaired or replaced at the cafe's expense. Any damage or spoilage must also be rectified before the premises are handed back.
The cafe was also warned against causing damage to property while removing its equipment, signs, or personal belongings.
Everything must be removed
The municipality demanded that the cafe completely remove all personnel, belongings, and equipment from the premises, and ensure that everyone using the facility through this enterprise has vacated. The notice stated: 'You must also remove all persons, belongings, and equipment from the premises; ensure that everyone using through you has left; and return all original and duplicate keys and access devices to the Municipality.'
A joint inspection will be conducted before the official handover, the date and time of which will be agreed upon with the municipality.
Legal action may follow
The municipality also clearly stated that this notice does not affect any other claims that may arise against the cafe. It clarified: 'This notice does not waive any rights or claims of the municipality, including the right to recover unpaid rent, interest, damages, legal costs, and any other amounts due.'
The municipality warned that failure to meet the vacating deadline could lead to legal action. 'If you do not vacate and hand over the premises in the required condition by September 30th, the municipality reserves the right to initiate or continue necessary legal proceedings.'
