Rocket Lab has formalized its protest against NASA's decision to award a contract to Blue Origin, Jeff Bezos' company, for the development, launch, and management of a new communications orbiter destined for Mars. On Friday, the 11th, the company filed a challenge with the Government Accountability Office (GAO), the body responsible for examining disputes related to U.S. government contracts.
The NASA decision stipulates a payment of $700 million, equivalent to approximately R$ 3.7 billion, to Blue Origin for the development of the Mars Telecommunications Network (MTN). This project is crucial for establishing an essential communication channel between operators on Earth and other agency spacecraft investigating the red planet.
Through a post on the X platform, Rocket Lab alleged that NASA's determination deviates from the eligibility criteria defined by the United States Congress. Furthermore, the company questioned the methodology used in evaluating its own technical proposal.
The company stated: 'NASA's decision appears inconsistent with the eligibility criteria determined by Congress. Moreover, the agency's punitive evaluation of Rocket Lab's technical volume was inconsistent, making incorrect statements and conclusions.' Rocket Lab emphasized that procurement standards aim to ensure fair competition and protect public resources. The objective of this protest is to ensure that such standards are observed in infrastructure considered vital for Martian exploration in the coming decades.

This conflict reflects a previous situation experienced by Blue Origin itself. In 2021, Jeff Bezos' company appealed to the GAO after NASA selected SpaceX to provide the first crewed lunar module for the Artemis program. At that time, the GAO denied the protest in July of that year. Subsequently, Blue Origin filed a lawsuit against NASA but lost the legal dispute in November 2021.
However, the company's history had a different outcome. NASA opted to select a second lunar module for the Artemis program, and Blue Origin won this contract in 2023. Currently, it is up to Rocket Lab to try and reverse NASA's decision using the same challenge procedure previously employed by Bezos' company.
