Major General Feroz Khan will face an independent medical expert if he does not appear before the Madlanga Commission on September 28.
The Madlanga Commission has postponed the testimony of Deputy Head of Criminal Intelligence Feroz Khan until September 28. This occurred after he was unable to attend Tuesday's session due to a recent hospitalization.
The Commission Chairperson, Judge Mbuyiseli Madlanga, adjourned Khan's testimony after his lawyers appeared and requested additional time. The lawyers also objected to the possible appointment of an independent medical expert.
However, Madlanga set strict conditions for any further absence. Khan can be excused from appearing on September 28 only if he undergoes an independent medical assessment before September 8. The specialist must be agreed upon by Khan's representatives and the commission's evidence leaders.
The result of this medical report must be submitted by September 15 to confirm that Khan is medically unfit to give testimony. If the parties cannot agree on a specialist, the chairperson of the South African Psychiatric Society will appoint an independent medical specialist.
Furthermore, Madlanga required Khan to provide his unsworn statement by September 2026. The chairperson noted that Khan's diagnoses may be made public, but detailed information regarding his clinical symptoms, treatment, and family circumstances must remain confidential.
Khan was readmitted to the hospital last weekend shortly before his scheduled appearance. The Commission emphasized that his court date remains legally valid despite the hospitalization.
