The Supreme Court ruled that forcing a person to leave a city or district affects freedom guaranteed by the Constitution. In this regard, the Court decided that the government is not entitled to issue orders for exclusion from the city on a regular basis; instead, it is obliged to adopt reasoned resolutions to justify such severe measures.
The Court emphasized that objective materials and a clear link between these materials and the conclusion reached are necessary to prevent the arbitrary use of power.
Furthermore, the Supreme Court overturned the order of District Magistrate Raigar, stating that the mere existence of multiple criminal cases is not sufficient grounds for taking such measures.
