China's real estate sector is already grappling with stagnation and significant debt burdens, but a new and more serious problem has emerged. The expiration of lease agreements for thousands of commercial properties is approaching in the country.

Uncertainty surrounding land ownership rights is undermining investor confidence, causing sharp declines in asset prices, and making the sale of these properties extremely difficult.

According to a Bloomberg report and estimates from Cushman & Wakefield, the lease term for non-residential properties valued at over 1 trillion yuan (equivalent to $148 billion USD) expires in 20 years or even sooner. This uncertainty, which has persisted throughout five years of real estate decline, is putting immense pressure on developers and investors.

In China, all urban land belongs to the state. Developers or citizens are not landowners; instead, they are granted the right to use the land for a specific period. These rules were established in the early 1990s. As lease terms expire, investors are confused about whether the contract will be renewed, what the required fee will be, and for how long the rent will be increased.

This crisis extends beyond documentation and affects transactions. According to Cushman & Wakefield, banks are reluctant to provide refinancing or new loans for properties with less than 10 years remaining on their lease. JLL notes that insurance companies and large investors prefer to invest only in properties with at least 20 years remaining on the lease.

Buyers are demanding substantial discounts given the potential future costs of lease renewal. Office space prices in major Chinese cities have fallen by more than 40% from their peak levels. Chinese developers have already declared defaults on debts amounting to approximately $130 billion USD, and the inability to sell assets complicates fundraising.

CBRE forecasts that by 2030, about 30 million square meters of office and retail space in 18 major Chinese cities will have less than 20 years of lease remaining. The actual figure could be higher as it does not include owner-occupied properties. Seeing the deepening crisis, the Chinese administration has begun taking measures. Following Guangzhou, Shanghai officials have also released a draft set of guidelines to determine the terms and cost of lease renewals in order to reduce market uncertainty.

The Central Bank of Uzbekistan has put forward a proposal requiring commercial banks to inform borrowers about potential financial risks when obtaining loans. The draft changes have been published for public discussion.

Requirements for Advertising and Contracts

According to the draft, advertisements for credit products must include a prominent warning that failure to meet debt obligations may lead to financial losses. The regulation stipulates that at least ten percent of the total advertising space or broadcast time must be dedicated to this warning.

Furthermore, a separate requirement is stipulated for the loan agreements themselves: the warning must occupy at least thirty percent of the main area on the first page of the document.

It is expected that the warning text will clearly state that overdue payments can cause an increase in debt burden, the application of compulsory collection measures, asset seizure, and freezing of funds in bank accounts. It is also noted that payment delays will negatively affect the borrower's credit history.

Central Bank Control Mechanisms

The draft also includes provisions that grant the Central Bank the right to restrict or prohibit a bank from carrying out certain financial operations or expanding its infrastructure for up to six months if the proposed credit product is deemed misleading to consumers.

The proposed amendments have not yet come into force and remain open for public review and feedback.

Sea Legend Shipping is starting to offer the China-Europe Arctic Express (CAX) service this month. According to local media, this service plans for eight voyages between August and October, utilizing seven vessels, with an estimated transit time of twenty to twenty-two days.

This service will transport cargo from various eastern Chinese ports, such as Shanghai or Qingdao. After stopping at the port of Ningbo-Zhoushan, the vessels head to Felixstowe (UK) and also have connections to other European ports, including Rotterdam (Netherlands), Hamburg (Germany), or Gdynia (Poland).

The schedule published by the company currently features two routes: the first, on the vessel 'Dubai Tower,' which is expected to depart from Ningbo on August 15th and arrive in Felixstowe on September 7th; and the second, planned for the vessel 'Riyadh Mukaab.' The new service follows the voyage of the vessel 'Istanbul Bridge' last year, which was recognized as the first passage along this trade route.

Unlike that trip, which was a one-off event, CAX now has fixed departure dates, consistently assigned vessels, and a planned travel time.

According to information previously provided by Sea Legend Shipping, traversing the Northeast Passage reduces sailing time by almost half compared to the traditional route through the Suez Canal, which takes about 40 days. Furthermore, it is approximately five days faster than the China-Europe rail route, which takes around 25 days.

Hu Jimu, a professor of the Maritime Silk Road at Huaxia University Institute, told Global Times about the importance of developing alternative routes due to growing risks in traditional routes, such as rising fuel costs and operational issues in certain corridors because of geopolitical tensions.

Currently, the Northern Sea Route is navigable only in the summer, but the melting of Arctic ice could potentially extend the period during which container ships can operate, opening up economic and geopolitical opportunities for Russia.
