Minister of Communications and Digital Technologies, Solly Malatsi, stated that data packages with a validity period of seven days or less will be exempt from the automatic data rollover rules set by the Independent Communications Authority of South Africa (ICASA).
Earlier this year, ICASA amended the Consumer and Subscriber Service Charter Regulations, making it mandatory to roll over unused data packages, voice messages, and SMS from January 2027, but excluded packages with a validity period of up to seven days from this rule.
In a written response to Parliament regarding an inquiry by Economic Freedom Fighters (EFF) member Siksolisi Gsilise, who questioned the impact of this exemption on low-income consumers reliant on daily data packages, Malatsi noted that ICASA believes requiring the application of rollover rules to short-term packages could reduce competition and limit operators' ability to offer innovative and affordable short-term data products.
Malatsi emphasized that ICASA considered the implications of including packages with a validity period of up to seven days when developing the revised Consumer and Subscriber Service Charter Regulations. He added that such packages are often purchased and usually offered as discounted promotional products.
According to ICASA, obligating such packages to comply with rollover provisions could decrease competition and restrict operators' capacity to provide new and inexpensive short-term data products. The Minister clarified that this exemption is intended to maintain the availability of low-cost short-term promotional packages widely used by consumers, including low-income users.
Malatsi concluded that, in ICASA's view, removing this exemption could lead to a reduction in discounted offerings and ultimately put consumers, whom the Regulations are meant to protect, at a disadvantage. He also stated that ICASA must consider all possible measures to ensure consumer needs regarding accessibility are met.
