The National Civil Aviation Agency (ANAC) has determined the limitation of the sale of airline tickets from the Argentine company Flybondi within Brazilian territory. This regulatory measure was implemented after the responsible agency identified a deterioration in the quality of services provided by the company, evidenced by a high number of canceled flights, inconsistencies in the information provided, and failures in passenger support.
Operational Restrictions Imposed
The decision, which is already in effect, prohibits the company from expanding its activities in the country. Specifically, Flybondi cannot sell tickets to previously planned Brazilian destinations, such as Florianópolis, Maceió, and Salvador. Furthermore, the inclusion of new routes, frequencies, or any alteration to its air network registered with ANAC is forbidden.
Additionally, ANAC suspended the sale of tickets for the Buenos Aires–Rio de Janeiro (Galeão) route starting August 3, 2026. This suspension will remain active if Flybondi does not provide proof that it has implemented the necessary adjustments to ensure the regularity of its services by that date.
Causes of the Regulatory Decision
ANAC's inspection uncovered a series of recent operational problems at Flybondi. An alarming piece of data is the cancellation percentage: between July 1st and 27th, the company canceled 79% of flights registered in Brazil. The audit also found a decrease in the company's operations, discrepancies between the registered flight schedule and the flights actually executed, and a general increase in passenger complaints.
In addition to operational challenges, deficiencies in consumer service were detected. These failures include difficulties encountered in the company's communication channels, complaints regarding refund processes, flight changes, and assistance to passengers affected by cancellations.
Passenger Rights with Issued Ticket
It is important to note that the ANAC determination does not invalidate tickets that have already been purchased. Passengers whose trips are already scheduled retain their valid reservations.
In cases of flight cancellation, the company remains obligated to provide assistance as established in ANAC Resolution No. 400. If the cancellation notice is communicated less than 72 hours in advance, the company must provide means for the traveler to reach their destination without incurring additional costs.
The primary options offered include rebooking on another flight, either with Flybondi itself or another airline. Another alternative is the possibility of rescheduling the ticket for a date and time chosen by the customer, without penalty fees, provided there is availability. If none of these solutions meets the traveler's needs, they have the right to cancel the trip and request a full refund of the amount paid.
Assistance in Case of Delay
In the event of a delay, the airline must keep the passenger duly informed after one hour of waiting. If the delay exceeds two hours, providing food is mandatory. If the delay exceeds four hours, the company must guarantee accommodation and round-trip transportation between the airport and the hotel.
